GAMA’s commitment:


1° When the risk is covered, payment within two weeks is ensured on presentation of the full claim file.

 

2° When the risk is not covered, recovery from liable Third parties taken care of.

 

What to do in the event of a casualty?

Consignees and/or Beneficiary will be required to have any damage and losses noted in accordance with the provisions of the General Conditions Forms governing this contract, and especially chapter V of the Maritime Form of 30/06/83, as amended on 16/02/90.

 

 

Reminder of essential formalities to be fulfilled in the event of a casualty

  1. Take all reasonable care with everything concerned with goods and take all protective measures with a view to preventing or limiting damage and losses

  2. In the event of visible damage, ensure reservations are made on the delivery note or the transport receipt and confirm them IMMEDIATELY by registered letter with acknowledgment of receipt

  3. In the event of non-visible damage, notify reservations by registered letter within THREE DAYS of delivery. Do not hesitate to take reservations on the delivery note or the transport receipt if the state of the goods is uncertain

  4. For goods loaded in containers:

    • check the seals are intact and that their numbers correspond with those stated on the transport document. If this shouldn’t be the case, make reservations on the delivery note, do not unload and call in a Claims Adjuster (see below)

    • in the event of damage noticed during unloading, and not visible on delivery, formulate reservations by registered letter within THREE DAYS and call in a Claims Adjuster (see below)

  5. In the case of partially missing consignments, ask for the intervention of the Average Agent whose name is stated on the reverse of the insurance certificate. Remember that the term of the insurance does not exceed 60 days from the end of the unloading of the goods from the last ship (shipment by sea)

  6. Appraisal:
    Do not forget to invite to the assessment the Carrier, the Packer, the Supplier and more generally any Person who could be rendered liable. This invitation can be made by telex, fax or registered letter. In the case of major casualty, call upon telex, fax, registered letter. In the case of major casualty, call for the appointment of a court designated Claims Adjuster in liaison with the Average Agent.

  7. If the need arises, especially if the one year time bar is liable to be implemented in the Carrier’s favour, ensure that you obtain an amicable report of the effects of the Carrier’s time bar or, or failing that, take legal action to put an end to the time bar.

  8. In the event of non-delivery, the participation of a Claims Adjuster is not necessary but the Carrier should be required to issue a definitive certificate of non-delivery. Generally, the Shipping Company reserves the right to carry out investigations during the six months following the appraisal.

  9. In the event of declaration of a general average, sign the average bond in liaison with the Claims Adjuster and add the note “subject to challenge of the general average principle, if the case arises, and settlement figures”. As a matter of urgency send the Insurers a copy of the average cover to be paid.

Reminder of documents to be produced in the event of a casualty

  1. Particular averages:

    - Original copy of the insurance certificate
    - Commercial bill of origin and packaging note
    - Original copy of ticket
    - Reservation correspondence
    - Original copy of the appraisal report
    - Statement of the Carrier or Stevedore’s report
    - Weighing slip
    - Certificate of non-delivery
    - Invitation of Parties to appraisal
    - Proof of adjournment of time bar

  2. Total loss:

    - Insurance certificate
    - Commercial bill of origin and packaging note
    - All original copies of tickets
    - Copy of manifest establishing that the goods were actually on board

  3. General average:

    - Copy of the insurance certificate
    - Copy of the commercial bill and packaging note
    - Copy of bill of lading
    - Average cover to be paid.
    - If a contribution has been made, receipt of provisional contribution, blank endorsement
